Terms and conditions
Welcome to www.olfactif.com (the “Site”), which is owned and operated by Olfactif LLC (“Olfactif” or “us” or “we”). These Terms and Conditions set out the terms of your use of the Site and your purchase of Olfactif products and services, including the Olfactif membership subscription. Review these terms when browsing our Site or before purchasing products from us. We may modify these Terms at any time and post them here.

Site use
We welcome you to browse our Site without registering or purchasing and without providing any personal information. By using our Site, you agree to be bound by these Terms. But if you wish to purchase products or an Olfactif subscription, you will need to indicate your understanding and acceptance of these Terms by following the instructions on the Site. If you do not agree to these Terms, you will not be able to purchase our products or become an Olfactif member and you should not continue using the Site.

Eligibility
You must be eighteen or over to purchase products through the Site. By providing information to us through the Site and agreeing to purchase a product, you agree that you are at least eighteen years of age.
Purchases
If you purchase a subscription or other products from us, we will ask for your email address, name, shipping and billing addresses, and valid payment information. We may also ask for additional optional information, such as your birthday, to help customize your subscriber experience, but optional information is not required. You agree that all information you provide with respect to your purchase of products and payment will be accurate and complete. You agree to pay all charges incurred by you at the prices in effect when those charges are incurred. You will be responsible for payment to Olfactif of the applicable taxes relating to purchases on the Site.
All orders are subject to our acceptance. We may refuse to accept any order, or any portion of an order, in our sole discretion, even if we have provided a confirmation of order. If we discover that a product was listed at an incorrect price, we may reject or cancel orders purchased at the incorrect price, even if the order has been confirmed or your credit card charged. If we cancel an order after charging your credit card, we will promptly credit your credit card account in the amount of charged.
The Monthly Subscription
If you purchase a monthly subscription, your membership will continue until you cancel it and we will charge your credit card monthly on your renewal date. If you cancel before the 15th of the month, we will process your cancellation immediately. If you cancel on or after the 15th, you will receive one more collection prior to your cancellation taking effect.
If you purchase a fixed-term subscription, your subscription will auto-renew when it completes. You will receive email notification prior to renewal so you may cancel if you choose.
Intellectual property rights
Olfactif owns and retains all proprietary rights in the Site and the subscription collection service, including and without limitation to all content, graphics, video, sound, Olfactif logos, software, trademarks, service marks and other material therein (the “Content”) and all intellectual property rights associated with the Content. The Site is intended solely for your personal noncommercial use. Olfactif and the Olfactif logo are registered or unregistered trademarks and property Olfactif. All other trademarks are the property of their respective owners.
Any content—including text, video, audio, or pictures—that you may provide to us, whether through the Site, email, social networking sites, or otherwise, will remain your property. However, you agree that Olfactif shall have the irrevocable, perpetual right and license to copy, modify, transmit, post, distribute, display, and perform all such content for promotional and other purposes without attribution or consideration.
Privacy
Use of the Site is also governed by our Privacy Policy, which is to be considered part of these Terms.
Disclaimers
Information on the Site or any catalogs or listing of our products may contain errors, inaccuracies, omissions, or outdated information that may relate to our products, pricing, or availability. We may correct or update any of this information at any time without prior notice.
Olfactif makes no warranties regarding the operation of the site or its content.
We offer third-party products for sale through the Site. Although we try to qualify these third-party vendors and products, we cannot guarantee the quality or safety of those products. Any purchase of third-party products through the Site is at your own risk and you should use your reasonable judgment in confirming the safety and appropriateness of such products for you. Olfactif expressly disclaims any liability or warranty with respect to such third-party products.

Olfactif often provides information regarding or links to other websites. We are not responsible for the availability, security, safety, or quality of such websites or any products or services that you may find therein.
Disputes
If there is any dispute about or involving the Site and/or any product you have purchased from us, by using the Site, you agree that the dispute will be governed by the laws of the State of Illinois without regard to its conflict of law provisions. You agree to personal jurisdiction by and venue in the state and federal courts of the State of Illinois.
Indemnity
If you violate the Terms or Privacy Policy of the Site, you agree to indemnify and hold Olfactif, its subsidiaries, affiliates, and their respective officers, agents, representatives and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, due to or arising out of your use of the Site in violation of these Terms, your misuse of any product, and/or arising from a breach of these Terms.
Location of Site
The Site is owned and operated by Olfactif from the United States of America, and all information is processed in the United States. Those who access or use the Site from other jurisdictions do so at their own volition and are responsible for compliance with local law. You also agree that any information you provide through the Site may be maintained and processed in the United States.
